All business partners of Curato undertake to comply with all applicable national laws, regulations, directives, and guidelines, as well as relevant internationally recognized standards, the OECD Guidelines, and the principles of the Universal Declaration of Human Rights. Particular regard must also be given to the following non-exhaustive list of legal, social, and environmental fundamental principles. <\/p>\n
Each business partner of Curato undertakes to make business decisions solely on the basis of objective and factual criteria, without regard to personal interests, and to avoid any form of conflict of interest.<\/p>\n
All business partners are required not to exchange any anti-competitive information and to strictly comply with antitrust laws.<\/p>\n
Each business partner of Curato undertakes not to tolerate corruption and to comply with all applicable international and local anti-corruption laws and standards. This includes any benefits offered or granted to public officials or other third parties in order to obtain a business advantage. Likewise, such payments or benefits must neither be demanded nor offered by any business partner of Curato. <\/p>\n
This applies in particular to so-called \u201cfacilitation payments,\u201d which are expressly prohibited. Each business partner must establish appropriate internal control mechanisms and training measures to prevent corruption. <\/p>\n
Curato expects its business partners to promote free competition. This includes compliance with all applicable competition rules, as well as relevant national and international antitrust laws and laws against unfair competition.
Each business partner of Curato undertakes not to participate in anti-competitive agreements and not to exploit or abuse any dominant market position in violation of applicable competition rules. <\/p>\n
All business partners are required to document potentially sensitive contacts with competitors (e.g. at industry association events) and, where appropriate, have them reviewed from a legal perspective.<\/p>\n
Curato\u2019s business partners comply with all laws prohibiting money laundering or the financing of illegal or unlawful activities. They must ensure that they conduct business only with reputable partners, i.e. partners who carry out legitimate business activities using funds from lawful sources. <\/p>\n
Curato expects its business partners to implement appropriate compliance measures to prevent money laundering, including Know Your Customer procedures.<\/p>\n
Each business partner shall comply with the applicable data protection framework. Data processing shall be carried out only to the extent necessary in a transparent manner. The rights of access and rectification, as well as, where applicable, the rights to object, restrict processing, and erasure, must be respected. <\/p>\n
Business partners must implement appropriate technical and organizational measures in accordance with Article 32 GDPR to protect personal data against unauthorized access.<\/p>\n
Each business partner undertakes to comply with all applicable national, European, and international import and export control laws, in particular sanctions, embargoes, and other relevant regulations and laws.<\/p>\n
Curato expects its business partners to have appropriate compliance processes in place to prevent violations of export control and sanctions regulations.<\/p>\n
Curato is committed to complying with the employment and working conditions recommended by the International Labour Organization (ILO).<\/p>\n
Curato expects its business partners to comply with all applicable labor laws and to ensure that their employees are provided with the employment and working conditions recommended by the International Labour Organization (ILO).<\/p>\n
This includes the prohibition of discrimination, the provision of safe working conditions, fair remuneration, and respect for freedom of association.<\/p>\n
Each business partner shall comply with the United Nations regulations on human and children\u2019s rights and shall not employ any individuals under the age of 16. Where national regulations on child labour set stricter standards, the business partner shall comply with those higher standards. <\/p>\n
Business partners must implement appropriate control mechanisms to prevent child labour within their supply chains.<\/p>\n
All forms of forced and compulsory labour are not tolerated. This means that business partners must not make use of any labour performed involuntarily under the threat of penalty, including forced overtime, debt bondage, prison labour, slavery, or servitude.
Each business partner also undertakes to take action against forced and compulsory labour. This includes measures to combat modern slavery, human trafficking, and exploitation within upstream supply chains. <\/p>\n
Accordingly, Curato expects each business partner to treat their employees with dignity and respect. Sanctions, fines, or other penalties or disciplinary measures may only be imposed in accordance with applicable national and international standards, as well as human rights. <\/p>\n
Each business partner must ensure equal opportunity and equal treatment, regardless of race, colour, gender, religion, political opinion, nationality, social origin, or other distinguishing characteristics.<\/p>\n
Each business partner shall ensure that no employee is subjected to verbal, psychological, sexual, and\/or physical abuse, coercion, or similar forms of harassment. Intimidation by the employer is strictly prohibited. <\/p>\n
Curato also expects business partners to establish an internal grievance mechanism for incidents of discrimination or harassment.<\/p>\n
Each business partner of Curato must pay its employees fair wages that are at least in line with the statutory or collectively agreed minimum wages applicable in the respective region and must comply with all applicable legal requirements regarding working hours. Unjustified wage deductions are not permitted.
In addition, employees\u2019 professional skills at all levels should be promoted through appropriate training and development measures. <\/p>\n
In addition, business partners should promote fair remuneration practices and provide training to support the qualification and development of their employees.<\/p>\n
Each business partner must comply with all applicable occupational health and safety regulations.<\/p>\n
Curato expects its business partners to take all necessary measures to ensure a safe, healthy, and hygienic working environment. Such measures include, in particular, regular risk assessments, protective measures when handling hazardous substances, safety devices on machinery, and relevant employee training. <\/p>\n
Internationally recognised occupational health and safety and social standards must be observed (including, among other things, the provision of welfare facilities and access to drinking water of potable quality). In addition, each business partner shall support the continuous improvement of working conditions. <\/p>\n
To the extent permitted by local law, each business partner shall recognise and uphold the fundamental right of its employees to form and join trade unions and employee representative bodies. The establishment of, joining of, or membership in a trade union must not result in any disadvantage. <\/p>\n
The introduction of communication and grievance mechanisms is encouraged.<\/p>\n
Business partners undertake to expressly reject unlawful forced evictions and the unlawful deprivation of land, forests, and waters in connection with the acquisition, development, or other use of land, forests, and waters whose use secures a person\u2019s livelihood.<\/p>\n
If business partners engage or make use of private or public security forces to protect a business project, they must ensure that such personnel are appropriately instructed and supervised so that internationally recognised human rights are respected.<\/p>\n
Curato aims to deliver the highest possible standards across all product categories and services without neglecting its environmental responsibility. With the understanding that natural resources can only be sustainably protected and preserved through effective environmental and climate protection in compliance with national and international laws and regulations, we place great importance on environmentally responsible and sustainable practices in order to contribute to a secure future.
Business partners are encouraged to implement environmental management systems (e.g. ISO 14001) and to regularly review their environmental objectives. <\/p>\n
Curato expects each business partner to ensure the safe and environmentally responsible development and production of products, as well as their packaging and transport. This includes, for example, assessing their own environmental impact, implementing management systems (e.g. in accordance with ISO 14001 or an equivalent system), and improving resource efficiency.<\/p>\n
Each business partner is expected to maintain procedures and systems that sustainably optimise the use of all relevant resources, such as energy, water, and raw materials.<\/p>\n
Each business partner is expected to maintain at least procedures and systems that ensure the safe handling, transport, storage, recycling, reuse, and management of raw materials, materials, and waste.<\/p>\n
Each business partner undertakes to take appropriate measures to prevent or minimise adverse impacts on human health and the environment.<\/p>\n
Business partners must, in particular:<\/p>\n
(1)<\/b> comply with the requirements of the Minamata Convention in the manufacture of mercury-containing products, the use of mercury in manufacturing processes, and the treatment of mercury waste,<\/p>\n
(2)<\/b> comply with the restrictions of the Stockholm Convention on the production and use of persistent organic pollutants (POPs), as well as their environmentally sound handling and disposal,<\/p>\n
(3)<\/b> refrain from any transboundary movement (import or export) of hazardous waste that is prohibited under the Basel Convention.<\/p>\nIII. Process Safety<\/h3>\n
Each business partner is expected to implement a management system to control operational processes in accordance with recognised safety standards. Where appropriate, specific risk assessments for facilities must be carried out. For all facilities, business partners shall take appropriate measures to prevent incidents, such as the release of chemicals and\/or explosions. <\/p>\n
Each business partner undertakes to supply Curato with products that are safe for their intended use and to provide all relevant product information in a timely manner prior to delivery or performance. This includes, in particular, information on composition, use (such as safety data sheets, processing instructions or assembly instructions, as well as occupational health and safety measures), and, where applicable, disposal.
Furthermore, each business partner undertakes to provide additional specific documentation upon request. Curato must be informed without undue delay of any safety-relevant changes or risks. <\/p>\n
Each business partner is expected to conduct clinical studies and\/or animal testing only in accordance with international guidelines and applicable national and local regulations and to limit them to the absolute minimum necessary.<\/p>\n
Each business partner shall ensure that no products supplied to Curato contain metals whose source minerals or derivatives originate from conflict-affected and high-risk areas where they directly or indirectly contribute to the financing or support of armed groups or do not meet social expectations.
The applicable EU Regulation on supply chain due diligence obligations shall apply. <\/p>\n
Curato expects its business partners to comply with the Curato Supplier Code of Conduct. Upon entering into or renewing a contractual relationship with Curato, each business partner must confirm that they will adhere to the standards of conduct set out in this Supplier Code of Conduct. <\/p>\n
Any breach by a business partner of the standards of conduct set out in this Supplier Code of Conduct may jeopardise the business relationship with Curato and may result in its termination.<\/p>\n
This Code of Conduct shall be communicated by each business partner within their organisation.<\/p>\n
Curato reserves the right to verify compliance with the above-mentioned requirements, either by Curato itself, through independent third parties as part of audits, or by reviewing official certifications.<\/p>\n
